Your Rights
You have the right to:
Access your records. You may ask to see or receive an electronic or paper copy of your health record and other health information we maintain about you. We will respond within the timeframe required by law and may charge a reasonable, cost-based fee when permitted.
Request corrections. You may ask us to correct information you believe is incorrect or incomplete. If we deny your request, we will explain why as required by law.
Request confidential communications. You may ask us to contact you in a specific way or at a specific location. We will accommodate reasonable requests.
Request restrictions. You may ask us to limit certain uses or disclosures of your health information. We are not always required to agree. If you pay for a service in full out-of-pocket, you may ask us not to disclose information about that service to your health plan for payment or healthcare operations unless disclosure is required by law.
Receive an accounting of certain disclosures. You may ask for a list of certain disclosures of your health information made during the previous six years.
Receive a copy of this Notice. You may request a paper copy at any time, even if you received it electronically.
Choose someone to act for you. A legally authorized representative may exercise your privacy rights on your behalf.
File a privacy complaint. You may contact Nomadiq RD’s Privacy Officer or file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. Nomadiq RD will not retaliate against you for filing a complaint.
Your Choices
In certain situations, you may tell us how you want your information shared, including with family members, friends, caregivers, or others involved in your care or payment for your care.
If you are unable to tell us your preference, we may share relevant information when permitted by law and when we believe doing so is in your best interest or is necessary to address a serious and imminent threat to health or safety.
We will obtain your written authorization before using or disclosing your health information for purposes that require authorization under applicable law, including certain marketing activities or the sale of protected health information.
If protected health information is ever used for fundraising communications, you have the right to tell us not to contact you again for that purpose.
How We May Use or Share Your Information
We may use or disclose your health information without separate authorization when permitted or required by law, including to:
Provide and coordinate your care, including communicating with other healthcare professionals involved in your treatment.
Run our practice, including care coordination, quality improvement, compliance, administration, and practice operations.
Bill for services, including submitting information to health plans or other payers when applicable.
Protect public health and safety, including certain legally permitted or required reports.
Comply with federal or state law, health oversight activities, or legally valid government requests.
Address workers’ compensation, law enforcement, or legal proceedings when disclosure is permitted or required by law.
Conduct research when applicable legal requirements and privacy safeguards have been met.
Work with coroners, medical examiners, funeral directors, or organ and tissue donation organizations when applicable and permitted by law.
Sensitive Health Information
Some types of health information may receive additional legal protection.
If Nomadiq RD maintains substance use disorder patient records protected by 42 CFR Part 2, those records will receive the additional protections required by federal law. Part 2-protected information generally may not be used or disclosed in investigations or legal proceedings against you unless the applicable requirements for your written consent or a qualifying court order and subpoena have been met.
For patients receiving services in Wisconsin, certain information—including some mental health, substance use disorder, developmental disability, and HIV-related information—may receive additional protections under Wisconsin law. When applicable state law provides greater privacy protection than federal law, Nomadiq RD will follow the more protective requirement.
Nomadiq RD will also comply with applicable privacy and health-record laws in other states where services are provided.
Our Responsibilities
Nomadiq RD is required by law to protect the privacy and security of your protected health information.
We will:
Follow the privacy practices described in the Notice currently in effect.
Notify you as required by law if a breach occurs that may compromise the privacy or security of your information.
Not use or disclose your information except as described in this Notice, as otherwise permitted or required by law, or as authorized by you in writing.
Allow you to revoke a written authorization as permitted by law. A revocation will not affect actions already taken based on your authorization.
Nomadiq RD uses electronic systems, including Practice Better, for services such as scheduling, communication, documentation, billing, and client-portal access.
We may revise this Notice. Any revised Notice may apply to information we already maintain as well as information obtained in the future. The current Notice will be available upon request.
